I am really not familiar with the laws in your state. I am sorry I cannot answer that question. My state law does not allow the employer to set the amount of benefit. The WC carrier has to provide payment for all reasonable medical expenses as long as they are provided by the primary physician or referred by the primary physician. At some point the carrier will try to settle the case with the claimant to avoid further expenses. Do not do this! It might seem like a good Idea at the time. You get a large sum of money at one time but then you are stuck with all future medical expenses. Like I said I am not familiar with your state and it may be different in UT.
I do believe that the employer does care. I just don't see how he can be so neglectful not to train an employee to use a machine that will most likely kill you if used incorrectly. What cuts me to the core is that the law allows him to act in this neglectful manner.
I would have thought OSHA would have fined the **** out of this company for lack of training. I hope the company has learned something from this and train everyone from now on. Next time they may not be so lucky.
I cannot imagine what you are going through. It must be really hard to see your son go through this. Especially knowing that this could have been prevented if someone had took the time to train him properly. My thoughts and prayers are with you and your family.
