I was recently released back to work, but my employer said that i needed to be able to do 4 ten hour shifts to have "my" job back. Then they gave it to an African American who will do the job 2 ten hour and 2 eight hour shifts.

They had told me the ONLY issue they had with my returning to my job was the hours (needed 4 ten hour shifts) I had a release from my doctor for the 4 tens, then they spoke with him and wanted a gradual release so he adjusted it to 5-8 hour shifts for 2 wks then re-evaluate and would release me back to 4 tens at that point
He is also upset that they pulled this switch, replacing me "out " of my position completely.

Isnt this illegal on so many levels ?

please reply as soon as possible. I have a meeting tomorrow with them so they can explain their thinking. Opps they just called back and said no meeting. The job hours were changed after they discussed it with me, so they say could not have offered it to me .

again isnt this illegal on so many levels?

Was on reduced hours due to back injury, catching a patient that fell, they said "strain" was healed, all left was pre-existing, but left me at limited hours when they closed case. I got my w.c doc and my pcp to release to full duty, and so on and on
One of largest employers in Oregon. difficult to fight them . :(

Do you have an employment contract or other agreement (union?) which says the employer has to have cause to fire you?

non union, no agreements and they havent fired me... replaced me and willing to find me "acceptable" work in another clinic...

So, what's the problem? It sounds like the are trying to accomodate your injury with more acceptable work.

Certainly doesn't seem to have anything to do with job discrimination and harassment.
