I Live in Oregon.have 2 boys who's father commited suicide in early 2000 iam remarried my children want the stepfather to adopt them..Question 1: Do i have to notify the biofathers family?
Question 2: How can I get paper work to file this myself with out a lawyer?

1. Not that I am aware of..
2. I would advise against this.. but if you must, then check out the services of a paralegal, they will be able to help you with the forms and filing for a much cheaper rate than an attorney. With an uncontested adoption an attorney should not charge you more than a few hours work.

Here is another question..
My boys are reciving Soc Sec off the biofather.
I guess what Iam wondering about is...In my Soc Sec books I rcv'd it states they will NOT stop reciving this BUT I have been told that they will...??...Iam a little confused..

Also.Once the stepfather adopts them does that make his CS drop from a son of a marraige before ours,Since my boys become his and his responsablity as well...??....

1. I am not 100% sure.. normally it would stop.. but in this case the father is dead as opposed to mearly allowing an adoption. Even more reason to look at retaining an attorney in your area.

2. Unlikely. It is one thing to have a new child, but to adopt children and then ask for a reduction in an exisiting CS order ?, highly unlikely..

In same situation!

Hi, I live in Oregon also. Medford area! I want to adopt my step-son. His mother was killed in an automobile accident. I have talked with an attorney and he says the law is that the grandparents must be served with notice and given an opportunity to establish visitation. Probably not what you wanted to hear! Also there are do it yourself legal packets available to order over the internet or there is a local shop here in town where you can get them. I am moving to Idaho in about a month but would be happy to get the forms for you and send them to you. It would require some exhange of money through the mail. Im not sure how much the forms are, but don't think they are much. You can email me at ebaying@yahoo.com

Just noticed your other questions...No, their social security would not stop. I called social security myself to ask about my step-sons social security and yes the child support would go down because he would legally be your husbands child and considered a dependent. I am not a lawyer and this is not legal advice, just letting you know what I have been through in Oregon! Good Luck!
