I got a call from the Magistrates office at ten thirty at night telling me they had my son in custody and I had a half hour to get there or they would take him straight to jail. Couldn't get a straight answer from anyone on what it was all about, except finally someone got on the phone and told me he had missed a court date. Couldn't tell me what the court date was for. Couldn't tell me how much bail was going to be either. I rushed around trying to get there on time, because they were adamant that I only had a half hour. It takes at least that long for me to get to town. Got there half cocked and with no info at all. It ended up taking a couple hours to get all paperwork done. At any rate, there are three people here who keep track of my son's court dates, and this one he supposedly missed was a total surprise to everyone. They were going to take him to jail over it, and ended up revoking his Personal recognisance bond on the charges that he was supposedly supposed to be in court over. The magistrate eventually dismissed the capias warrant for not showing up, because we were adamant about the fact that no one knew that he had court that day, but I still had to cough up over $300.00 to keep him out of jail. Lucky for my son I just happened to have almost the exact amount in my purse! I asked the magistrate to write out all his scheduled court dates for me so this couldn't happen again, which he did. He told me that we would get the new date for these particular charges in the mail. This morning it came. I went to write it on the calendar, as that is how we keep track of things, only to find that it was ALREADY THERE! I went back and checked all the case numbers on the paper he had handwritten, the paper he sent in the mail, and on the papers we got the night I paid his bond. They were all the same. He had the correct dates right in front of him on the computer the whole time! He had a bad attitude when I was in the office, didn't want to answer any of my questions and basically tried to intimidate us. The bottom line is my son was arrested because of a mistake in the Magistrates office, and the magistrate never admitted that there could be a mistake even tho he had the real dates right in front of him. I now have all my ducks in a row. I feel I should be able to get my $300.00 back right now, and he should be put back on p.r. How can I fight the system, and get my money back from people who refuse to admit they could make a mistake? Can they keep the money anyhow because when he was pulled over that night he had an expired inspection sticker? (I was told the bond was for the charges he was supposed to go to court for ONLY, but the papers state that he can't break ANY laws or it could be revoked.) My car is now in impound. This mistake is ending up costing us alot of money as it is. What can be done about this?
