What is the name of your state? What is the name of your state? California
My boyfriend an I just signed a one year lease two months ago, which my dad co-signed for. Now he decided to move out of the apartment and leave me with the lease to pay. I can't afford to pay the amount of the monthly rent with the income I have, plus I have three children to support. My monthly income totals the amount of the month's rent plus i have a car payment and the utility bills to pay. What can I do to at least make him pay for his share of the rent?? I don't want them to go after my dad for us defaulting on the lease. Please help!!!!!!!!!!!!!!1

Why did he bail out?
Are your children his?
If he is the dad there should be no problem making him pay...

Your questions to the OP are irrelevant. It does not matter WHY he bailed or IF the kids are his... If you're thinking child support, by the time it went through the courts, she would already be evicted...

Unfortunately the OP is responsible for the remainder of the lease terms and the full amount each month... The LL does not care who pays as long as he's getting paid. Yes, the LL can go after the co-signer as well... The only option is to pay the full amount each motnh, try to find a roommate, and if that fails, you can sue your BF for 1/2 the amunt in small claims court...

Correct 'Who's Liable'... How ever the OP asked: 'What can I do to at least make him pay for his share of the rent??'

My questions were to enable a response to her question of how to get him to pay his share, off course she has to pay her rent anyway she can right now.

My questions related to any options open to her to get him to pay now or eventualy.

She can sue him correct 'for anytime she does not take on another sharer', on top of this she mentioned support of children, he is responsible to assist anyway if the children are his.

So her options to go after him are pretty open.

**A: you can sue his ass. That's what you can do. Or send Luigi over to his place and make him an offer he can't refuse.
