About 5yrs ago, I moved into an apt complex. 2 months into the lease I found out I was pregnant and had to be placed on bedrest for the rest of the pregnancy. Because I couldn\'t work, I had to move back in with my parents, and provided documentation to the leasing office. They charged me regualar rate for 2 months of the lease. They are now bankrupt and the collection wants the money. But, I thought providing my medical records excused me. Plus, if the company has gone out of business, why should the collection agency try to get the money.

Providing medical records will do nothing to get you out of a contractual obligation. I'm sure your lease spelled out the consequences of breaching the contract and medical condition or not, you're still responsible for the breach.

The fact that they have since filed bankrupcy in no way gets you off the hook for what is owed.

so who will the money go to then?

I don't know. If the collection agency was only hired by the apt. complex, then the owners of the complex would still be the ones to receive the money, bankrupcy or no. If the collection agency bought your debt, then they get the money. Either way, it doesn't really matter, you still owe the debt.

MandyD is correct, your condition did not get you out of your obligation ... you owe the debt ...

And you better pay up as the only other way to get out of paying this is for you to personally file Bankruptcy. The laws are changing very fast on that as well. In a year or so, it will be VERY difficult to get a chpater 7...
