I just got home from an appointment with my attorney. STBX's attorney sent a settlement offer(whatta joke). There are some totally RIDICULOUS things in there! STBX wants shared custody with weekly exchanges(he lives in another county) and doesn't even bother to see or talk to the girls other than every other weekend, half of the money that we sold two parrots for two months before we seperated, our 18 yr old sons Jeep that was titled to son alone and has been sold, 18 yr old sons spare Jeep parts, a battery charger and floor jack that were stolen at least a month before seperation, the antique sewing machine that I bought from his cousins yard sale, a Last Supper picture???, and the treadmill that we bought at a yard sale for $25 to help with my disability. AND, in the papers his attorney says that STBX withdrew $25,000 from his 401K on October 1st "to survive" on. BUT, I have the print out from Fidelity that shows that he took the money out on December 8th and received a certified check on December 14th. Why did he need $25,000 to survive on since he wasn't even paying his child support or alimony? He brings home $5660 a month! I thought that neither of us were allowed to do such things during the temporary phase.
The proposal also states that I am able to earn "in excess of $40,000 a year". I have been a stay at home mom for 15 years! I was a registered EMT, but my certification expired on December 31st. I also have a letter from my physician that states that I am physically unable to work in a full time capacity.
Anyway, my attorney says that we are going to go to trial. I need to know what to do to prepare for a trial. What information will I need? What exactly is a trial???

You need to ask these questions of your attorney is a lot more familiar with the local rules and proceedings than any of us are. Also your attorney knows your case.
