Builder won't install oven per contract

Hi,
I closed on a new house about 7 weeks ago. The appliances(oven, dishwasher) to be put in by the builder were to be black. I was responsible for the refrigerator, which I bought also in black.

When we closed, the oven had not yet been put in, but the black dishwasher had. Our contract states a 'black Hotpoint' oven.

Well, they installed a black and white Frigidaire oven. It is ugly! I have never even seen a two tone oven! An electric oven, the top surface is white, the main oven door is black, and then the bottom broiler drawer is white. It looks like a zebra!


I have contacted the builder, who says he lost money on this particular house...to which my reply was 'not my problem'. He says there is no way in hell he is going to replace the oven. The listing realtor has not been any help. Altho, she did suggest we not use the oven until this is resolved. So, I have a new house, with a new oven that I can't use.
I have a contract signed by the listing agency, the builder, and my realtor, as well as myself.

What is my recourse? Is it going to cost me more than it is worth to even mess with? Who is the responsible party for this? The listing agency, the builder? My real estate agent has been doing all she can do to rectify this, but is not getting anywhere with discussions.

**A: the party that signed the contract and sold you the house is responsible.

Did the builder state ALL black appliance? Did you see a picture of the appliance prior? It sounds like he threw together a stove with parts from one black and one white....lol.

I just want to warn you that black shows everything.....fingerprints...washcloth trails.....dust.......
