can education background be used for demotion

i have been employed for 15 years w/a local government organization(library). started part time and have risen to dept.head..there are 6 current dept heads. Director of the library is re-organizing and is giving all those dept heads with MLS degree the opportunity to appy for new positions (Manager titles). i will not have that opportunity beacause i have LTA not MLS. Is there any basis for job discrimination because of education bias?

You need to locate a labor lawyer near and consult with him immediately. You can find one at this web site's attorney listings. You want to make sure that said attorney represents mostly, if not exclusively, public employees (aka civil servants). Under the federal case of McGraw v. City of Huntington Beach, 882 F.2d 1989, you may possibly have a constitutional property right in your current position. Whether that means you get to keep that position because the library is merely changing the name of the dept heads, I don't know. Your attorney will need to see the employer policies and procedures manual, company handbook, whatever you want to call it. Best of luck to you.
