I have posted on here before about visitation for my kids father, he is in NC. My question is he called me today and told me that if I wont send our son (he is 1yrs old) to NC then he wouldnt see him. He said he is not comin to TN to visit him. He also said that his lawyer told him that since he pays CS he can come and get his son anytime he wants too. We also have a daughter (7mths) but he doesnt want her just our son. He said his lawyer will be contacting me about our son. If we go to court will the judge look at him strange that he doesnt want our daughter just our son????? Yes we have had paternity tests for both of them...

A one year old could be 9/10 months older than a 7 month old...depending on what someone defines as a "one year old".

And how are you supposed to send a 1 year old to another state? Put him on a plane by himself and hope he gets there okay? Do you already have visitation orders and what do they say? Call his bluff. Wait for his lawyer to contact you. Nothing is legal unless it's in writing. As far as a judge thinking it's strange he isn't interested in the daughter......maybe, maybe not. A judge may see his reasoning as the baby being too young to leave the mother for an out of state visit....but then a 1-yr old isn't much older so go figure. On the other hand, some judges will only rule on what's presented them at the time. If your ex doesn't mention wanting visitation with the 7-month old, then it's not even addressed.

My son is 22mths old (hence 1yr old) there is no court order for visitation. i told him that he could take me to court. He said he would come here and get him, but our son doesnt know him. He hasnt seen him since Aug 04, and I told him that once he gets to know him, I would send him to NC for a visit. But not a moment sooner.
