Can I ask for a copy of what I signed during an HR investigation?

What is the name of your state (only U.S. law)? NV.

This is what would happen during an HR investigation.

The director of HR (she) would ask me questions.

She would write everything she asked me on a notepad and write down all my responses.

She would then allow to read what she wrote.

She would ask me to sign and initial what she wrote.

Then she would keep that copy of what she wrote and I signed and not give me a copy of it.

Can I ask her for a photocopy of what I just signed?

Can I refuse to sign it if she refuses to give me a copy of it?



A friend of mine got fired by the director of HR and this how she did it.

She wrote down was said and she asked him to sign and initial it.

After my friend signed and initial it, she went back and altered and edited what she wrote.

Yes. You can ask, doesn't mean you'll get one
Yes. you can refuse to sign it.

AND like your friend
you can be fired for all of the above.

Nevada law gives you the right to view your personnel file. It's a bit ambiguous, at least in the summary I read, whether or not the law entitles you to a copy. The law does give the employer the right to charge you for copies if they are provided, but only the actual cost of making the copies.

You can refuse to sign - you can be fired for your refusal.

If it's not in his personnel file but is part of an investigation (I missed that) he has NO right to it. Even in the states that grant an unconditional right to a copy of the personnel file, notes regarding investigations are generally excepted.

Quite frankly, if these are investigative notes he's lucky he's being allowed to read them. Copies - no way.

And, as previously indicated, short of a gun to his head no one can force him to sign, but his job is not protected if he refused.

If it is in regard to an unemployment insurance issue, the firing was perfectly legal. But it is possible that in determining whether or not the employer had good reason to fire the employee, they may be submitting the documents, and that they may have altered the documents after the person signed them. All the claimant would need to do in this circumstance is tell the adjudicator that the documents were altered. They'd determine whether or not this appeared to be true. But since an employer can pretty much fire you for just about anything quite legally, it doesn't make any difference whether you have a copy of anything or not. You're not going to be able to take it to an attorney and demand restitution or your job back or anything, regardless of what you have or have not signed.
