the implementation is either a state or possibly even a local action. The ADA sets standards but does not enforce those standards not do those standards have to be followed.

This can be easily seen if you research the requirements to signs and markings for HC spaces throughout the country. Each state has their own specific rules as to how to mark spaces as well as how many and in what situations HC spaces are required. Some of them default to the ADA standards, some do not.
 


Well, in case anybody is wondering...

The local building department acted like they didn't know what a handicapped parking space was and refered me to the state building codes. The state of Oregon has adopted the standard federal ADA guidelines and nothing more.

According to the ADA Title III technical assistance manual:
If a lot is limited to the exclusive use of employees, and none of the employees are individuals with disabilities requiring accessible parking, accessible spaces may be assigned to employees without disabilities.
As the only employee allowed to park in the lot at night, I have assigned the space to myself. I'm parked there right now, and no, I won't get a ticket according to the local police department.
