Can I get custody of my daughter back?

tennessee-my parents adopted my daughter when i joined the navy 2.5 yrs ago. since then, my father died and my mother's mental health has declined. the envronment that my daughter now lives in is detrimental to her physical and mental health. i am now in a situation, with full Navy financial support, that i can care for my daughter financially, physically, and emotionally. she is 10yrs old and has consistantly made clear that she wants to live with me. i am sure with the evidence of her mental and physical state that getting custody won't be a problem. the problem is: can my mother or another family member(my bro/sis)prevent the transfer to Japan due to the fact that my parents had custody for so long? (bro is getting discharged from Army for adultry and high year tenure) (Sis is 'strung out' on various drugs) if you have any ideas, please let me know asap, as i am in the states for a very limited amount of time. i am also trying to contact a lawyer. thank you for any assistance you can give. angela

If your parents ADOPTED your daughter, you are going to need their cooperation to get custody of her. Perhaps you could approach your mother with concern for the "what if" scenario.

HumorMe is correct in the sense that you need to have your mothers cooperation in order to have any chance. If you do not have that help from her, then you first have to report the situation to CPS and have her deemed unfit. The child will need to be taken into care for protection. On a successful bid by the CPS that your mother is seriously neglecting the child you could then file a petition for custody based on being an interested family member.

Since you (for some unknown reason) desided to abandon the the child and allow her to be adopted, you currently have no legal rights to the child. Also, since you do not reside in the US, the chances of winning custody after proving your mother unfit and having charges brought against her is silm since your mother would probably gain some visitation which would generally mean the child stays in the state.
