Can I get it dismissed?

What is the name of your state? Utah

I filed through the Office of Recovery Services for a support modification. They computed the new child support amount and my ex is fighting the amount. We both recently filed our financial declarations through the court and there is no difference in either figures so the computed child support is right. He filed his with the same income that ORS reported. Can I file a Motion to Dismiss and not have to wait for a court date and receive the increased child support without another court date?

He does have a right to an appeal. If he hasn't presented any errors in the findings of fact and conclusion of law in his appeal, then the Judge will overrule. He should pay that increased amount until the hearing, just to be on the safe side.
