Can I Reverse A Chapter 7 Discharge?

I had a medical bill for my father's nursing home discharged last September 2005. I was being pursued by their attorneys as they stated I owed the money. I signed a form stating I was the "guarantor" in case my father could not pay the bills.

I found out about two months ago that since the Nursing Home was a medicaid-accepting facility, they had no legal right to ask me to sign as a guarantor. In fact, they were knowingly violating the law by doing so. However, I was duped into believing I was legally responsible at the time that I was responsible.

Knowing that they violated the law (and since finding out they no longer have contracts that ask relatives to sign up as the 'guarantor'), I want to clear my name and not have this bankruptcy hold itself over me for the next 10 years.

Can a bankuptcy judgment be rescinded? This was the only debt I listed on an otherwise spotless record.

Afraid not. What's done is done and as far as I know there is no way for a debt to 'reverse' a bankruptcy. The BK court or a Trustee can REVOKE a discharge and dismiss a case.

If you want to go after them, hire a lawyer and sue them or file a complaint for their illegal actions.
