I had a lot of trouble at my previuos employ. My car was vandilized tree times while I was working, time cards and postings dissapearing, supervisor aiming at me like he`s shooting me,etc. I was sent home by a supervisor who had been riding me and others{I had been told by my union reps not to say anything but to ask if I could have one of them present. The supervisor began screaming at me without cause and I requested a union rep as told. When the union rep came he told me that I was being sent home for insaboardnation. A week late{1 week without pay} I was called into a meeting with the owner. By then they realized I hadn`t been insabordanant. So they had another supervisor say that I had abandoned my job {2 months previous I had gone home sick and notified the supervisor, Also the contract states that any disiplinary action must be taken with in 7 days}. Then they said I had bad attendance in which I explained that while we were walking into the meeting the union pres&vice had said they just checked my attendace and I had a good one, especially compared to the other employees their. I explained to the owner that I was being discriminated against listing incidents including those stated above. He said you can`t prove it. I told him, some I can`t and some I can. I asked why I had been intially charged when all I did what my union told me to. He said you don`t listen to the union{The president and vice president of the union sat their and didn`t say a word the whole meeting}. I was then told that I could resign and sign a release in which I`d recieve 6 weeks severance and he`d guarentee me no problems with obtaining unemployement benefits and give me a good letter of recomendation. Or I`d be fired in which I`d recieve no severance, they`d fight to keep me from getting unemployement and it would take at least 9 months to get to arbitration and they wouldn`t give me any letters of recomendation. I signed the release{It basically states that I can`t sue them for discrimination} but I feel that`s under duress. I have most of the meeting taped. I never refused, ignored,or was even given any order. I never abandonded my job. Can I still file a law suite even though I signed the release? I live in PA but I worked in NJ, where do I file a complaint?Can I sue both the union and the employer since it is a union only workplace and I followed instructions given by the union and they didn`t make any attempt to represent me?
