Can I sue for child support that my mother never recieved?

I live in WV but lived in CO till age 13. For a brief time Welfare(in CO) gave my mother a child support check even though my father could not be found. For the majority of my life we've struggled desperately because of having more bills and needs than we could afford. Now that I'm an adult my father has contacted me. He makes $12 an hour and has no one to support but himself. I feel that my mother and I deserve something from him besides false apologies and lies. Is there anything I can do to get the support my mother was denied for so long?

Hire a lawyer who should first check to see if the statute of limitations has expired. If it hasn't, then go after him.

Wouldn't it have to be the mother that goes after the father since the monies was due to her??

Child support belongs to the child.

Excuse my ignorance, but isn't child support paid to the mother, so the child can live "in the means that he's accustomed do"?? It generally goes toward, rent, food, groceries, clothing, etc. Even though it is for the child, the CP uses it at their discretion. Therefore, one would assume that the mother is the only one that can legally pursue back child support???

If the mother (CP) dies and dad does not want the kid to live with him, then would you agree that all child support stops?

I'm not an expert in this type of law, but it's a great question.... , I would think that if the child was under 18, when the CP dies, then the CS would go to the new guardian of the child, or special account setup?? Although, I still think it's the mother's issue, not the child's...although, again I'm not expert.

I hope this kid and family, rights all the wrongs that obviously have gone down for several years now.

I agree. Unless there was a standing child support order you and mom are out of luck.

Of course, you could always contact the Colorado welfare office and let them know where dear old dad is living. I'm sure THEY would like their money back ;)

I don't read that the cp is dead. So the debt would go to the Mother because that is who the support is paid to.

That's true....and since he's making a whopping $12.00 an hour, I'm sure he'll easily have that bill paid off before hell freezes over ;)

You are correct and I gave the only advice available to this poster in the first response.

To answer my own question: Of course not. CS still goes on because it belongs to the child.
