Can I sue my dog breeder?

I purchased a female registered dog from a breeder. She stated (I have proof of this) that certain health testing had been performed on the dogs parents. Specifically I was told that the dogs parents had been cleared for glaucoma/catatacts.
My dog developed cataracts at 1 year old. I looked for proof that the parents were tested and found nothing. I asked the breeder to provide me proof of health testing, she refused.
My question is, because she advertised the dog as having been from health tested stock, can I sue her for misleading me and get back what I paid? Especially given that my dog developed an eye disease?

Yes, you can sue and attempt to get your money back. Trouble is, most puppy mill breeders are scammers and deadbeats. Even if you get a judgment, good luck collecting.

My daughter bought a dog from a puppy mill. Ended up spending thousands when the dog got sick. Turned out that the puppy mill breeder had been sued before, had complaints with the state, kept changing addresses, started and closed businesses frequently, etc. The dog is alive and well and my daughter decided it wasn't worth the aggravation of going after the breeder.

And as pets are considered property, if you won in court and she had to return your purchase price, you may have to return the "merchandise." So are you willing to relinquish your dog?
