I dont know if this question goes here but here it goes:
My husbands ex has issued a criminal trepass against me, when she asked me to pick up the kids and i did, when I got there she called the cops and told them that she did not want me at her house and she did not know I was coming to pick them up. She has also filed police reports that I have been harassing her by phone calls and the dates that she filed I was out of the state. I Ihave my plane ticket to show that I was on the plane on that date and time. Mu question is do I have a case against her or the police department for issuing it?

I would take all of the information that you have to the prosecutor's office and make copies for them. if you can prove that you weren't there, they can't do anything. Also, you need to tape record conversations so that when she asks you to come, you can have it one tape.

You can't sue the police department, they were acting honestly on the information they were given.

Hopefully, the prosecutor will charge her with filing false reports and then you can sue her!

For starters - simply being out of state doesn't prove you didn't place harrassing phone calls. What is she using as proof?

As for taping her - you'll want to check GA taping laws to see if you can legally do so.

I dont know what she is using as proof. But as far as the phone calls i am under the impression that you cannot use the phones on the plane without a credit card which I do not have nor do I have a cell. But as far as the call to pick up the kids, my husband heard the conversation. So what should I do?
