Can someone PLEASE help me

Hi, im really needing some help. We live on an army post and our daughters were molested. Along with several other children in the neighborhood, by a 9 year old boy. Not ONLY did the police never file this, they didn't file a report on the harassment we received by the parents of the boys or the threats. They would not allow us to move, or make them move. They never informed CPS OR DHS or CID to investigate. It was all swept under the rug. My children have not played outside since July and are still forced to go to school with this boy and the school has not been helpful in keeping him away from them. When I finally started getting angry enough, i posted on the housings facebook pages that this was wrong and we shouldnt be forced to keep our daughters inside because no one will do n e thing about what has happened. Finally we were given a meeting with my husbands chain of command, in which they treated us like criminals, threatened my husbands job and rank, and threatened that if we did not keep quiet this would be turned around on us. NO EXAGGERATION!!! They then had my personal private emails and told the other family that they could sue us because i threatened there safety in them. BUT I never did this!!!! Jag sent me a certified letter stating they would be taking action against me for all these things i didnt do and would not return my phone calls. NO LAWYER WILL TOUCH THIS. NO ONE will help us. Our civil rights have been violated in more then one way, and I just can't believe that no one can help us. Can anyone help us?!?!?! We are in Colorado.

You have a complex situation of which all the facts can't be known by anyone here. To start, if this purported molestation happened on base, it might be a federal "crime". I put crime in quotes because, while I don't have a citation, it seems the infancy defense, where the actor is determined to not have the capacity to form the intent to commit a federal crime is 11. Perhaps that is a part of this issue.

Further, our society is so aghast against child molestation that teenagers sending naked pictures to their boyfriend/girlfriend is often treated as a serious crime. (Not to say it shouldn't be, but...) I find it hard to believe there would be a wholesale dismissal for proven issues such as this for no reason. That makes me think you may be overreacting to events or misunderstand what has happened or is happening.

The bottom line is that we are unable to help you. I suggest that, before you violate anything written you in the JAG's letter, you pay for your own attorney for advice.

Well, without violating my letter from Jag, I can say that my daughters were 5 and 6 and the boy was 9. My neighbors children(boy and girl) were 4 and 5, and there were three other families involved which I do not personally know. What I can say, is this boy used threats and physical aggressiveness with our children. Such as holding them down, pulling there pants down and telling them they were having sex. Locking my neighbors son in a room and chasing him telling him to do unimaginable things. And as such, our children have lost a magnitude of innocence that they will never given back. Criminally, nothing can be done to the boy because of his age, I understand that much. What I dont understand, is not allowing us to move(not to a different base, just a new neighborhood) or having them move(which we were originally told they were going to but never given a reason why they didnt) why my personal emails were accessed and used against me (however copies of my emails were never actually given to the parents... the parents were only told what they supposedly said) I never once gave any names or addresses publicly or privately but was accused of slander and libel against the parents none the less(which I know I did not do.) My childrens counselor has even made a statement that by keeping us here or allowing them to stay is having a detrimental effect on there treatment as they are the ones being punished and not allowed to play outside. i have contacted several attorneys about the way we have been treated, threatened, and our children not even being able to play in there own front yards and everyone just says they cant help. And they all just say we cant help you. when i ask for a reason they dont give one.

And how old are the other children?

The Military CAN NOT keep the non-military parent from moving with his/her children to another neighborhood.

OP lives on base. As such, the military can control what housing is assigned. Perhaps you are suggesting that the OP move to off-base housing?

Yes. That is what I am suggesting. That is what I would do to save my children this distress.

They told us we can not break our lease (we do live on post but the housing is contracted so we had to sign a lease), nor would they move them to another house on or off post. Under Colorado law I do know that if abuse is the case we do have a right to break our lease, but we have to provide the police report, which there are none. Not even the written statements my husband and neighbor wrote. There is NOTHING on record. I spoke to the head of the PMO (or guy in charge of the police station here) as to why there were no reports nothing, and all he could say was sometimes it happens and he is sorry. Basically what I want to know, is why they can do this to us, treat us this way, not let us move, invade my personal privacy when I KNOW i did nothing illegal, threaten my husband with UCMJ (take his rank and pay) because (I) said that I would not drop it and let them sweep it under the rug, and threaten us that if we did not keep quiet they could turn it on us. I mean what I am writing is all of it. There isnt much more to say about it. Nothing hidden no other sides, other then my neighbors side which she went through the same thing before she chapter-ed out and got to move because of that. I dont understand why no lawyer will help us and cant give us a reason why. i dont understand how they could possibly turn it against us? The commanding general of the post wont even have a meeting with me about this, but he is apparently aware because it was apparently him who got my emails. we were also told Jag was aware and they wont speak to us either??

we also can NOT afford to move us off post and my husband stay on post. He is only E4 and we dont make enough money to pay rent on two places, his name is on the lease, and we were told the only way to break it is if he deploys.

So, the police took a report, then it's not in the system and you didn't "re-file" the report?

oh we definitely tried to refile it, and we were told that reporting the same crime twice was illegal. that even though it was missing, we already reported it and if it did "come up" we would get in trouble. No joke. Thats half my problem, it really seems like they are trying like hell to cover it up. I just dont understand why??!!

No, I stay home and take care of our three kids while my husband is the one in the military.
