What is the name of your state (only U.S. law)? NY

Hello all! I have a client that wants to make sure they aren't breaking any laws about spam. They have a list of emails from people that signed up to attend an event. They didn't explicitly opt-in to receive emails, however if the copy reflects the event and no solicitation is involved, as long as they include an opt-out in the footer, then are they in compliance?

Seems pretty clear cut that the proposed message is a transactional one, and perfectly allowable under CANSPAM
