Ooooooh . . . you've got to keep up with your law!
John Doe subpoenas are no longer constitutionally permissible. Therefore, not even the Feds can get the information via subpoena.
Identity of anonymous Internet users:
The First Amendment also protects a party's right to speak anonymously by posting messages on an Internet bulletin board using a pseudonym:
"First Amendment protections extend to speech via the Internet . . . A component of the First Amendment is the right to speak with anonymity . . . (D)iscovery requests seeking to identify anonymous Internet users must be subjected to careful scrutiny by the courts." [See Doe v. 2TheMart.Com Inc.
