Recently my husband has been sent letters from Capital Mangement Services, INC representing Sherman Acquisition LP, they are saying that my husband owes on a credit card that he has never had; when we talk to them they give us the last 4 digits of the s.s. # on file and it is not my husband's ss# but it is very similar, and the birth date is also similar. They say he opened this account in April 1999, but this is the first he has ever heard of it, what should we do?

It sounds like an identity theft problem with someone else committing fraud. Find out if the police will let you file a report about this, but you also need to be contacting a credit bureau to report this (so they can investigate further) and explain the situation also to Capital.

Before you tell Capital about the identity theft problem, ask them to send you copies of the credit card billing so you can see what was purchased and whether the signature looks like your husband's or not.

*If* your husband is telling you the truth about never having the card, best conjecture is they obtained his credit report and they contacted him using the information obtained from the credit report. The credit bureau's computer yanked out his report from the mainframe as opposed to the report of the individual they're actually after. Sometimes this happens if there is a same last name with very similar information of the subjects. There's been a few times I've pulled credit reports, and the credit bureau gave me the report of the wrong person. It doesn't happen often, but it does happen. I personally review every single file and every single credit report and every single address, so I've been able to immediately nip mistakes in the bud and I've never pursued the wrong person. Knock on wood. Sherman and Capital Management deal in very high volume and make mistakes. "Laxity" isn't really the right word, but sometimes they get a little sloppy.

An attorney letter to them will prove very helpful. Otherwise, you'll be playing ping-pong with them and you'll drive yourselves crazy trying to resolve it.

You can follow through w/ possible identity theft (putting fraud alert on all CR's, police report, etc) and requesting validation from the CA. If your husband never opened or used this cc, then there will not any validation of the debt or there will be proof of identity theft. Send the letter certified mail, return receipt (for proof). Best of luck!

Sweetie, long ago I said part of my career involves some debt buying. I personally own several million dollars of crap debt. I've been involved with it for 15 years, long before any of the bigwigs even came along. I've been in the collections business itself for 25 years. I've worked in a law office for the last 15 years. I've also been ghostwriting pleadings and briefs for outside lawyers involving collections, landlord-tenant law, real estate law, and whatever else they've piled onto my back for the last 20 years. My J.D. was just a way to please my late father. I have so much experience in all of this crap, sometimes I feel like I'm drowning under the weight of it. That's why this Internet stuff is now such a relief and a break for me. If I tell you that you really don't know what you're talking about, it's because I've repeatedly seen it with my own eyes. Which is more than I can say about the new font on these forums. Even a hawk would go blind trying to read this. My eyes feel like they're being poked with forks, like on the cover of the Scorpions' album "Blackout."

Well, I never looked for any of your original posts where you outlined your history, there was no need. You don't have to be so insulting.. however, since you're a debt collector it's right in character !

I'm sure you've seen plenty with your own eyes, but that doesn't mean that things I've described don't go on in the rest of your industry. Your profession has a low-life reputation and from what I've seen it's certainly deserved. This isn't a 'one bad apple' scenario, most of the barrel seems to be rotten !!

I don't see anything wrong with the new font on the forums, what I see is about a 12 point font and its perfectly readable. I suggest you check your browser's text-size settings if it's too small. Mine is set to 'medium' in both browsers and its just fine.

Oh yes.. Drop the patronizing garbage - I'm not your 'sweetie', its an MCP kinda habit that men with major egos use.

What's wrong with Sweetie? It's nicer than calling you Catfish. Although, now that I think about, based upon your extremely valuable opinion, the next time a waitress or a receptionist calls me a patronizing Sweetie or an insulting Honey, I'm going to go nuts and make the broads eat the cement. WHAT EGOS! HOW DARE THEM!

You think we LIKE it when some total stranger calls us 'sweetie' ?? Believe me.. most of us don't. Women with the same habit are rarely being condescending or patronizing, though they can be, they just think its being 'friendly'. If you're a waitress living on tips, being friendly is part of the game. A receptionist is just being unprofessional, IMO, although I"m sure they think its 'friendly' too, it could also be considered flirting.

ladynred, I suggest you do exactly what I did - report stevek3 to the administrator of this site by clicking the "contact us" button at the bottom of every page. Or by clicking the red exclamation point sign in the upper right-hand corner of every post in this thread.

I have reported stevek3 for each and every incident in which he is rude (or in this case sexist). The administator thanked me and said I am welcome to do so at any time, and to let her know if he continues this rude behavior.

I would be careful stevek3, if you continue this behavior, no-one will want you here... and you will be banned.

I had no absolutely no idea that Colin Powell's children were now fixated upon "subversive" online posting. Gosh, I thought they had enough to do with policing all of the naughty radio and TV. When was your Internet Sheriff induction ceremony? I really wish you would have announced it beforehand. I would have sent you a bouquet of flowers and a fruit basket. I'm assuming I AM NOT LIABLE would have sent you a year's subscription to both Reader's Digest and Mad Magazine. Ladynred and Belize Breeze already told me they would have sent you a carton of Marlboros. I'm usually not one to brag, but my gift would have been better that any of theirs.

Ms. Powell, much like what's on the many millions of available TV and radio frequencies, if one does not like something one sees or hears, whether it's "offensive" words or opinions or whatever else a self-annointed cop doesn't like, then one can simply change the channel. No fuss, no muss. Really.

With that being said, I've noticed the "Senior Members" have a habit of referring to differing opinions as being idiotic, and have a habit of describing the people themselves as being bozos, clowns, morons, idiots, trailer trash, head lice, human Pez dispensers, and whatever other descriptive terms that are readily available in their colorful dictionary. While, more often than not, they are accurate in their assessments, it may also be considered "rude" and/or "sexist."

You'd better get to work, Sheriff. You don't have that shiny star displayed on your chest for decoration. There's a veritable online plague that desperately needs to be contained.

By the way, would my bouquet of flowers have been considered "sexist?" It was going to be a combination of white roses, red roses, marigolds, tulips and baby's breath. A nice cactus could be considered less "sexist," but I once had a cat that tried to eat one. He cost me a couple hundred dollars in vet bills.
