My question was simple: would it be possible for my case to be settled without my consent due to the fact that my lawyer is so 'unreachable'..
I apolagise .. and I got in touch with my lawyer the ball is still rolling.. Im just very uneasy it's been 7 years.
Ah, much better. Ok. Here's the easy answer.
Your case cannot ("should not have been" at least) settled without your consent. You can check the status of your case wiout your lawyer in two ways. First, set up a free account here:
http://www.e-law.com
Then go into it and enter the information about your case (party name, or index number) along with the county and it will tell you the latest details as far as what is pending, motions, conferences and prior dates for each.
Alternatively, you can go to the clerk of the courthouse in the county where your case was filed and fill out a little slip with the same information, and you will get the physical file itself. It is frequently difficult to decipher what is going on with just the court file, particularly for a non-attorney, so I'd try the e-law method first.
And if by any chance your case is in the Bronx, 7 years is not that unusual.
Good luck.
