That's a Denver ordinance. I suggest you plead not guilty (if you haven't already paid it) because that's not what you did.

You did not make a left turn within an intersection.

You did not make a left turn into an alley, private road or driveway.

A technicality, yes, and you are still at fault for the accident, but it's a possible way of beating the ticket.

Well damn, it's too late because I paid the ticket: I was under the impression I wasn't going to be able to beat it and didn't want to waste time. There's definitely lessons that have been learned here for moving forward. I appreciate your guys' feedback.

That means that you admitted to the violation which sinks you on the civil side.

2 months later, I finally got a response back from the other drivers insurance provider and they notified me after reviewing the video, they're accepting 100% liability as it didn't correspond with their drivers statement.

With that being said, they said their driver had a minimum liability with a total of $15,000 in property damage coverage so that's what they're working with. They said they're sending it over to their property damage adjuster to see what the costs are etc. I'm just not sure what will happen now because it's at the shop right now getting repaired and I've already spent $5,000 in parts and labor plus a rental for a week not including the additional costs every day for me to Uber back and forth to work for the last 2 months.

Will they end up cutting me a check for what I've come out of pocket or what they value in damages for my car? Based on what the adjuster said, he thinks it's totaling anywhere from $10,000-$12,000 but still needs to be reviewed by the property adjuster.

I just don't want to be cut short or screwed in all of this.

I haven't been following this thread from the beginning, so apologies if this has already been answered, but why on Earth would it take 2+ months to repair your car?

That being said, I would imagine you won't get anything until all repairs are completed, but you'll have to ask the adjuster. Also, depending on how much it costs you to use ride-share versus the cost of a rental car, the insurer may balk at paying those charges.

The accident happened on September 11. mobbdeep ordered parts for the car on September 24, and his friend was going to fix the car once parts arrived.

It really helps to read the thread.

I had minimum liability so everything has been out of pocket. I had a friend get it mobile and now it's in a shop for frame straightening, cosmetics, etc. The two months is how long it has taken the other insurer to get ahold of me. The accident happened on Sept. 1st and they just called me today telling me they're taking 100% liability for the accident. I've never heard a word from them until today.

You are EXTREMELY lucky, especially considering that you admitted fault.

I know. It's a blessing in disguise honestly. I just hope the rest of the process wraps up fairly quickly because it sucks being without a car and spending $150/week in Uber just commuting back and forth to work every day.

You're entitled to your actual cost of repairs and your actual costs for your Uber rides and rental. When you get your car back, submit all your receipts to the adjuster.

It's nothing short of a miracle that they accepted 100% liability for the accident. I still don't see it. But the decision may have been based on their insured's lack of credibility.

Take advantage of that and ask for Diminished Value. You'll certainly have some with frame damage on record, especially if you end up with a salvage/restored title.

Colorado: "Courts have held that “the measure of damage is the difference between its value immediately before its damage and immediately thereafter, together with any expense of reasonable efforts to preserve or restore it.” Trujillo v. Wilson, 117 Colo. 430, 434, 189 P.2d 147, 150 (Colo. 1948); Larson v. Long, 219 P. 1066 (Colo. 1923) (permitting “admission of evidence of the [diminution] in value of defendant's car because of its having been in the accident” because such “[diminution] is an element of damage”)." From a guide to "Diminution in value cases in all 50 states."

A question that came to mind since they accepted 100% liability for the accident, is there a way I can dispute my ticket since I paid prior to them accepting liability?

I just want to thank you guys for your advice and information you've provided. Even though the odds in my favor was slim to none, I'm glad the outcome was in my favor. We ended up settling $12,500 for damages, bodily injury, and Uber/Lyft reimbursement plus I got to fix my car.
