Car Accident Question...

What is the name of your state? Arizona

OK. I was on my way to get my family some food and a truck hit me. I was driving my dad's car, and had permission by my dad. So he called his insurance and filed a claim. I also live with my family. But today he recieved a letter by the car insurance company saying they are investigating whether or not I was insured. And they might not give us the money for the car (it was totaled).

My question is was I insured? He has full coverage, and it has happened before a long time ago with a different car insurance company, and they covered my dad's friend who totaled my mom's car. So how could they deny the claim?

Easy, they realize your dad is a LOSER for letting idiot people drive his car.

So maybe they will pay this claim, but I guarentee he will not get a renewal policy from them.

your dad is too stupid to have a car.

Underdog-23, interesting I have been posting questions on a "what if situation" that your situation has developed into (sorry for you luck :-( ) , to some extent for a 'friends daugher' see : 'how to get auto insurance under this situation' and see advise from runninng on empty. many of his/her comments could answer your situation

here is what i would do asap

(1) have your father contact his insurance company first. I was not sure in your wording 'if' you were saying he contacted his insurance or just the other guys? Even if the other guy is 100% at fault, YOUR fathers insurance needs to know about the accident asap. If he did not call them because (a) he/your are scared worred about NOT being insured and (b) you believe and or know or can later prove the other guy is at fault..you stilll need to get your insurance involved now. If it is your insurance that is putting up the red flags..and asking questions, that doesn't sound right because they should be able to detrmine and show and prove to you in the policy if you are NOT covered. Sounds to me like it's the other guys insurance doing the '..lets scare the kid' situation and not wanting to pay for the damage that their client did. GO STEP by STEP.

(2) sounds like many policys cover blood relatives, who have permission unless it is excluded in the policy. So you should be covered and more importantly LEGALLY able to drive the car, which may have been a question in your mind? (Obviously assuming you have a valid drivers license...if not, forget all above and start to pray!)

They may be trying to sare both of you..and hope you wil take a low ball offer on the payout of your car. You did not state that your are listed on his policy, so I am assuming you think your not, wich is why you are writting, right? But my guess is that you are covered. READ the policy and have your dad call his insurance agent now.

If you are a resident relative and are not listed on the policy then you may not be considered a permissive user.

When purchasing insurance, most policy applications ask you to list all licensed drivers in the household.

If there is a loss involving a driver who lives in the household and is not listed on the policy, then the company can deny the claim for material misrepresentation on the policy application.

This is a simplified explanation of what is happening in you case.

Ok. I did tell my dad to look at the policy, and the drivers are him, my mom, and my sister (since she is with the same company). However, even though I am not on the policy, they never asked my dad to list all of the drivers in the household. Me and my brother are fully licensed to drive, yet we are both not on the policy. Since they never asked about who is in the policy, I think it's just a scare tactic. I'm with you, though, because if they know I'm not on the policy, and if that's what counts, they wouldn't be sending me a letter saying they're investigating. They would've just said they were denying the claim. So since I am blood-related, had permission, and am licensed, I believe that I'll be insured.

Another thing: The accident might not be my fault. So they won't have to do anything about it anyways.
