I purchased a car in 2009 and Mission Financial financed the car for me since it was my first time financing a car. I made my payments but then my cancer was out of remission and I suffered a stroke in class on my college campus. I got behind on payments and told the company I would need them to pick up the car because I was ill. The account rep was rude and asked "what the hell was he going to do with the car?"

I understood I was under contract so I would send in what I could but treatment got overwhelming so again I asked them to pick the car up and sell it and I would have to pay the difference. I heard nothing from them for 4 months and they would not take my phone calls. I then got a call from a federal investigator saying the company wanted a writ of replevin and to call him back. I called him back and explained the situation and he said they told him that I could not be found. I played all the messages I left for the company and faxed the letters I sent. He said he would not issue the writ.

I got some money and sent in a large amount still trying to uphold my obligation. I do not hear from the company for 6 months but at around 4 am one night the repo man called me saying he was supposed to pick up the car but he was not going to. I told him please come because I could not pay. Now its 2 years later and I haven't heard from the company until last week when someone called my dad saying they were taking out a felony theft warrant on me.

My dad told them that the car was still sitting in the driveway because I had asked them to come get the car. A friend of my mother's owns a loan company so I asked him to what to do. On my credit report they have charged off the account saying they could not locate me. I was told they did that to get paid by the insurance company and then sold the bad paper so thats who was calling. I'm not sure what to do since they would not come get the car and its on my credit as triple the original loan amount. They will not respond to my phone calls, letters, or anything. I can't sell the car and pay the difference because I do not have title.

Sorry! Yes the question is do I pay the original creditor? The person calling my family members identifies himself as a federal investigator. How do I go about finding who to settle this matter with?

"Federal investigators" (which is a phony title anyway) don't call you. Tell whomever is calling that you do not conduct any financial business over the phone and that they need to send you any documents they have in the mail. Do not engage in any other conversation with this person over the phone. Do not pay attention to any threats they might make. If they could do any of the things they are threatening to do they would have done it already. Just hang up.
