Car totalled by drunk dirver

A drunk driver (second offense) ran a red light and rear ended my car going at a high speed on the morning of the 4th of July. My car is totalled. The guy has no insurance. Luckily I have uninsured drivers insurance. My car is not quite paid off. My insurance company is paying me for my totaled car but is there anyway to recoup the payoff amount for my totaled car?

you will only be paid the fair market value of your car by your insurance company. If you can show your car is worth more than what your carrier is offering, provide that information to the carrier as soon as possible.
