A drunk driver (second offense) ran a red light and rear ended my car going at a high speed on the morning of the 4th of July. My car is totalled. The guy has no insurance. Luckily I have uninsured drivers insurance. My car is not quite paid off. My insurance company is paying me for my totaled car but is there anyway to recoup the payoff amount for my totaled car?
Thanks!

you will only be paid the fair market value of your car by your insurance company. If you can show your car is worth more than what your carrier is offering, provide that information to the carrier as soon as possible.

Pimp;

This poster never mentioned this was a leased auto. In fact, the following quote shows that it is not a leased car.

If you don't know the answer to a legal certainty, please don't muddy the waters by assuming anything.

In fact, Stepenk was right on the money.

Do not assume on this board. It's hard enough getting facts from the posters that are relevant to the legal issues.

If you'd like to understand the process of this board, read replies from Stepenk, IAAL, BoxCarBill, HomeGuru and JetX, Qualified attorneys who offer straight (although sometimes harsh) legal advice based on the law.

And if they don't understand an issue, they will do the responsible thing, ask questions.
