Hello i would like some advice on a situation that im having. Recently i have made a contract with my CC company to pay off my credit card debt. The deal was that i had to give them 12 check numbers they can do electronic check payment for the next 12 months in turn they would change my 28+% APR to 5%. The first three payments would be 225.00 and 180.00 after that. well for the last 6 or more months they have been taking 225.00. What i would like to know since i signed a contract with them saying that i would be paying 180 a month to pay off a debt, and there taking more than that are they in breach? is there any legal action that i can take? What are my options.

Assuming you have this agreement in writing, they are bound to it just as you are. Your post implies you have the agreement in writing. Is that correct?

I would be very cautious about stop payments until you are sure you are at an impasse with the cc company. It is your right and perhaps you are justified, but you don't want to give them the right to raise the rate.

What have you done to communicate to the CC company that they are not following their agreement?

I have not told them about the error they have made.. i am still paying but i just noticed it this month. Yes this agreement is in writing. So if there in fault is it posable that this contract is null and void. ie.. could the amount owed be null and void? since all my debt from the creditcard was put on this contract with them? I cant seem to find my copy of the contract. Should i get a copy from them to make sure there isent any fine print about over drawing my checking account?

Well, if you have not told them about the error ---- jeez.

No, I don't think this error invalidates your contract. People make honest mistakes. If you have not told them about the mistake, you've not given them a chance to fix the problem.

Yes, I believe they should pay any overdraft charges you incurred. They may resist since you've apparently not been paying attention either. But, they should still pay the charges.

Contact whoever you worked with and tell them what happened. Be nice but firm. Tell them what corrective action you want.

If they don't take the corrective action, take a deep breath, post back and tell me what they had to say.

I would not say anything about not being able to find your copy of the agreement. There is no need to bring up that subject right now.
