What is the name of your state (only U.S. law)?California,
CC&R's Civil Procedure Section 1351 states limitations on who is responsible for termites? and common areas. My question is "if termites are found in the floorboard UNDER existing tub/shower enclosure and in the studs and supporting boards of someone living above you, who is responsible for repair?

**A: generally the components you described is considered common area in which case the HOA is responsible. Double check your condo docs for specific descriptions of what constitutes common area and components that should be maintained and repaired by condo unit owners.
