What is the name of your state (only U.S. law)? NJ

NJ law says that I am suppose to return the Security Deposit by Certified Mail, Registered Mail, or in person. If I send the Deposit back via Fedex with signature required, does that comply?

I would say along as it shows proof or delivery and signature required, than it would be sufficient. Ignore other comments, you wanted advice regardless if wasn't important enough to them, it was to you.

People like you make me laugh... you waste time pointing out and responding to questions you think are wasting your time... If you don't like the question ignore it and move on... no need to (TRY) and show your dominance by (trying) to belittle people. Obviously this is something I don't understand, and while you may think it's redundant and trivial, it happens to be an issue for me.

And yea I'm serious, I don't want to get hit with double damages for doing something incorrect... because I know the tenant is going to take me to court.

I'd appreciate a response from someone with some thing intelligent to add...

Hey genious, I didnt say anything about any other thread, but if you have more, why wouldnt you keep the same situation in the same thread. why have volunterrs go hunting down your history. some of us dont have all day, or even notice you have other posts.

I dont know why you couldnt put together, certified to provide proof, and another service that also provides the same proof. Does it provide the same proof of service?

Do you think the courts are keeping post offices open by demanding only post office certification??

proof of service by delivery man, or proof of service by delivery man. HM, that is a hard thing to ponder. thats the question you asked.

See how this small piece of info changes the answer? thats why you shouldn't go around starting new threads, and should keep it together so that a person who is not familiar with your posting history will have a background to what you are trying to do.

If this is the case, and you want to do it by the book, why are you even trying to change anything, do you have something against USPS? you cant go by there and drop something in the certified return receipt requested mail.

Since you want to have no mistakes, just send it as it is described, through the mail.

Ok, go send what you are sending through the mail, not fedex, not UPS, but just as it is described in the law... a certified letter, where the post offices sends you the ticket, with the signature of the person who got it.

I agree, the safest thing to do is just send it certified. The reason I was asking about Fedex (or Express Mail) is because I'm 1 week out from my 30 day limit on returning the Deposit... and due to issues with getting all the estimates and documenting the deductions, the refund won't be ready to go out until tomorrow morning. When I called the Post Office to ask how long certified mail takes to deliver, I was told there is no guarantee (although it should only be a couple of days)... registered mail could take up to a week. They suggested that I use Express Mail since it is next day delivery, provides tracking and requires a signature. So I was just trying to find out if there was something special about Certified Mail, or if anyone knew if Fedex/Express Mail with a signature requirement is just as good.

I do believe that if you mail it prior to the deadline, it will be fine as the court would go by the postmark.
