Full Custody?

My ex-wife is using drugs. I have photos, a police report and a person that took the photos who will testify in court. What are my chances of getting full custody since my ex-wife 6 years ago was arrested for child endangerment?

Does she do drugs in front of the children? Who's children was she arrested for endangering? Was she convicted? How old are the children? How long have you been divorced?

The Story

Ok here is the full story. 5 years ago my ex-wife had all of her kids taken away from her for Child Endangerment. She told me that she was smoking weed and the people that baby sat her kids smoked it to. Her 3 month old daughter had two broken legs and a bruised liver. Now I have pictures that were taken in her house of marijuana, a pipe to smoke it and scissors to cut it(all in the pictures). I also have the witness who will testify in court that he took the pictures along with his mother who instructed him to. The boy who took the pictures called his mom to tell her that drugs were in the house so she told him to take photos and some of the marijuana leaves back for evidence. When he came home we filed a police report with the Police Department. The detective told me that my ex-wife is under criminal investigation. I also have her past history documents through public records. The detective told me that he wants to charge her with 4 felony counts, one for each child that were in the presence of the drugs. With everything I have what are my chances to get full custody?

If the children were there then CSB should have been called as this is proof of child neglect and dependency.

You may have a good chance depending on how your evidence is presented, if mom is convicted (charges are not that important) and what happens when she is arrested.

Were the children that were taken away from your wife YOUR children? How old are your children? Was the 3mo old that was injured YOURS? How was that baby injured? Were the children she is currently under investigation for your children?

I tried to attend the hearings to find out what happened but her lawyer would not allow me in the court room. She is currently under investigation for my son, her step daughter and her 2 kids. I don't know what CSB is but I immediately contacted Child Protective Services and informed them of the situation. They came over to my house, questioned my son and I gave them the pictures and police reports. My son claims he is not aware of the drugs but he can identify the rooms in which the pictures where taken.

CSB is Child Protective services in your state. So file for custody in juvenile court if there has been an adjudication/disposition. If there has not been any court hearings in juvenile court for the CPS issue then file in domestic or whatever court has jurisdiction. Her remarrying 4 times is not a problem> CPS being involved is where you have a major positive on your side.
