I would like to know if is possible change my daugther last name. Let me explain. My daugther Yashira Ortiz, is 8 years old; I haven't seen her father since she born, but she has his last name. His name was Sergio Ortiz. Well I'm married for 6 years now and my husband and I want my daugther to have my husband name. By the way, my name is Denice Lopez and my husband name is Rafael Lopez; so, we want to name my daugther as Yashira Lopez. What should we do? Ho yes, I almost forget, we live in New Jersey.

Petition the courts for the name change. If the so called Father disproves he will have to contest it. There is no reason in the world that any judge would rule against this giving your situation.

Get it started, and change your daughters name.

Hello Mysonmom! Thank you for your advised, but except for my marriage, I never been in court or legal procedure, so to be honest with you...I'm lost here. What's next to get my daughter last name change? Where I have to go? Who I have to talk to? and is this expensive? because I hardly can afford one lawyer? and the most important question...My married name is MINE right?, so I can change my daugther last name even if my husband doesn't want to? (just in case...). You see, the thing is that every vary in my home is Lopez, my mother-inlaw, my sisters-inlaw, my little son, my husband of course, and me, except for my daugther; she is already making question, when she sing she write Ortiz Lopez, she is getting confusse and is not fair that she carry a last name of some body she don't even know and either show any interest in knowing her. I don't want her to think she is different for the rest of us or that she is less part of the family just for that. You know what I mean?
