if he was that bad, you shouldnt have had unprotected sex with him. now youre stuck dealing with him untill your child is 18, like it or not. changing your child's name requires dad's permission, theres no way around it.

OP would have us believe that she had no choice in the pregnancy.

You don't need dads permission, but you need to notify him. If he contests the name change he will have to appear in court and state his objections. You will probably have to state why you want the name change, and prove that this is in your childs best interest.

Judge will then rule, based on the arguments, on whether he/she thinks it's in the childs best interest.

At least that's how it goes in my state.

Bridgemom, unless you know the law in the poster's state, do not post how it works in some other random state. It's not helpful at all to give someone advice which is based on nothing. Around here, we prefer advice that is based on the law of the person's state.

Go to your local county building were you got your childs birth certificate from
they can help you you could have done it very simply if you would have done it the first year of your childs life im not sure how it works now but i do know that your local couty building will point you in the right direction :):):)
