What is the name of your state? Ohio
I'd love to hear from anyone in Ohio that has filed bankruptcy. I'm so confused! In fact, any advice at all would be helpful.

We bought our house last year and we have one car that is paid off and one that isnt'. Can you keep house and car when you file ch 7? Also, about how long do I have once I stop making cc payments before they seek a judgement? I was so busy trying to keep our cc's caught up, due to the past due fees and overlimit fees that pile on top, that our secured debts have fallen behind. I'm trying to catch those up now and have stopped trying to do anything about the cc's since I just don't have the money for both.

In Ohio, you can keep your house both in 7 & 13,
if you have no more than 10000.00 equity if you are married, 5000.00 if you are single.
the equity in your car can be no more than 2000.00

I just wanted to second what huk told you. I just filed Chapter 7 and had $4900 in equity in my house and my lawyer told me I was lucky it worked out that way...even though the trustee probably wouldn't bother going through the hassle if you were slightly over. The car equity of $200 is correct as well. If you are over on either of these you will need to file Chapter 13 if oyu want to keep the assets.

Just thought I would reaffirm since sometimes it is nice to hear from more than one source.

In regard to the credit card companies, my last payment was the end of December and I was getting bombarded with calls after only being 2 weeks late on payments. I tried to avoid the calls but they called 3 times a day (4 companies) so once I got a lawyer I told them I secured a lawyer and would be filing in March. They asked for his name and contact info and were acutally very pleasant on the phone after that. Now that I have filed they have left me alone all together.

thanks! and another question...

I have just picked up several books from the library about bk...most of them state that the exemptions apply to chapter 7 and not really to ch 13. Is this correct?
