In 2005 we filed for BK ch 7. I have a pretty good job, but my wife's job was out sourced. After we filed the trustee's office looked at our case and determined we had too much income. Also I mistakenly asnwere no to a few questions that I should have answered yes to, It was really just an honest mistake but that made them dig into our finaces even more.
Eventually they forced us into Ch 13.
Now after 22 month our financial situation has changed again. We have an adjustable mortgage that has gone up aobut $250 per month along with some other costs, like transportation and home upkeep (we need a roof and new flooring). My wife is a licensed massage therapist, but her income is aobut hald of what it was when we began this process.
Our monthly payment is $500 but we estimate we are going into the hole by about $500 per month. We are a month or two behind in all our utilities, etc.
I asked out attorney about trying to end the Ch13 but he says by law it must run 36 months.
I suggested ch7 but he reminded me of the scrutiny we came under when we first filed. He thinks they will tear into our lives again.
We are at the end of our rope. I thought BK was supposed to ease our troubles.
What are your thoughts?
Is converting to Ch7 the best course of action?
