In Oct. 2003 our BK was discharged. We did not reaffirm our mortgage but have kept on paying. In June 2004 they stopped taking our payments and after making a number of calls finally to took our payments by Western Union. They told us they could get us a modified loan for a year and would fax papers. We have received nothing, but I made 2 more WU payments. But I did not want to make more when I don't know where our money is going. After looking on the internet it seems to me we are just renters since we did not reaffirm the mortgage? We want out of this house but were worried that we would not get what we needed out of it. Our attorney told us nothing about this. But everytime I do call the mortgage company they say by law they need to tell us we do not owe this debt. Does this mean we can just walk away? What will or should be on our credit report? Thanks :confused:
 


If you did not reaffirm, you CAN just walk away. The debt was discharged in your BK and you are no longer liable for it.

Edited to add: The above advice is only IF you don't want to keep the home. If you stop paying on it, they will foreclose.
