What is the name of your state? Nebraska

I have a question on child support and bankruptcy. If you are current on child support and then file for bankruptcy how does that work? Can the custodial parent request an increase in child support? Will your current amount of child support stay the same, decrease, or go up?

I think it just stays the same unless someone, you or the other parent, requests for a reduction or increase. Then an evaluation is done on both incomes. I don't think bankruptsy has anything to do with any of it.

Bankrupty has no affect on child support. CS is not a dischargable debt. So, it can go up or down. Depending on PMS or your cajones.

I decided most of the people here deserve answers like IAAL gives them...especially the 26 year-old who wants permission to date a 16 year-old...

But hidden in my smartass way was the correct answer....Just hope he sees it.;D

If bankruptcy was filed, reducing debt, and increasing available income, then couldn't support be increased?

Yes and no. The two are not tied legally together. Hell, the earth could stop spinning after bankrupty is filed too, but that doesn't mean they are related.
