Child Support Reduction

What is the name of your state?North Carolina My current wifes' ex husband is seeking to reduce his child support payment by approximately 40%. His reasoning behind this is he has a new wife and child with her. He rarely spends time with his children he is paying support for now and in the past missed paying support for about 20 months. We provide the health insurance and pay all the medical bills, although he is supposed to pay half (our choice) The hearing is this Wednesday. Does anyone have any advise I can pass on to her? Some states allow a reduction for subsequent children, not sure if NC is one of them, but it will be no where near 40%. Once the hearing is over, your wife should file contempt of court against him for not following the court order re: paying support and paying 1/2 of medical bills.

Thanks VG. From my limited understanding; if Medical bills are not submitted to the NCP,then they would not be required to pay. After the hearing you can bet ALL medical bills will be submitted. Also, from looking at the child support worksheets a reduction may be in order here. I seriously doubt that he will get the 40%. Thanks again.

Make sure your wife sends the medical bills registered mail, return receipt requested. He'll have no leg to stand on by saying he never got them. Even if he refuses them, you wife will have proof.

NC allows for subsequent children. He can't get a reduction based on this alone. He has to have another reason for the basis but they will figure in other bio children living in the home.

As far as medical, I'm not sure how they will rule because the guidelines only say that the NCP is responsible for the first $100 and doesn't specify after that. So it depends on what the court order says.
