Child Support Review

I am Pro Se (lawyer withdrew due to non-payment and it was granted) and yesterday filed a motion for visitation assistance as my ex was refusing mid week visitation with our son along with other with visitation issues.

Today I checked the court webpage and found that his lawyer had filed a motion for child support review. I want to be very clear that I do not have a problem supporting my children and have the support taken out by my employer every two weeks. I am concerned that I will not be able to make increased child support payments. I am very frustrated because I am having issues getting it out of my head that this is retaliation for asking the court to enforce our current order. I am just barely making my payments for various lawyers, debts, and every day living expenses etc. Child Support was initially determined on minimum wage because at the time it was determined I was unemployed and had mental health issues. I have been able to stabilize my mental health issues and currently hold a 9-5 job making approximately $40,000. I have also taken a second job working every other weekend. I am concerned about working any more as I am not willing to jeopardize my mental health.

In calculating child support I figure it would go up by at least $500. I know that I can cut my expenses by about $100 a month (rice and beans here I come!) and take an extra shift or two at my second job to add an extra $100-200 a month; any more and I am at risk of defaulting on payments. I currently work in the financial services industry for my 9-5 and must have good financial status for my job.

So my legal question is: Is it possible to increase support to just double instead of triple what I currently pay? I am very torn because I want to support my children but need to be able to pay my bills and everyday expenses as well.

Unless the other parent agrees, it's not likely that you'll receive a downward deviation if you've been paying less-than-guideline before now.

May I ask what is your concern with my posting history?

How did your daughter change to a son? That is one question. You also have not been complete in prior postings if you have more than one child and more than one ex. That confuses the issue.
