My brother filed for a divorce from his wife of 7 years earlier this year. He currently has the kids (2 and 7) and she has visitation. She is fighting for custody. What are the chances that she get the kids if these factors exist(ed).
1) When we collected the kids from her parents, the kids had lice.
2) She has claimed to have a serious heart and liver condition from extended use of Paxil, Xanax (for her depression) and Vicodin, Morphine (for a degenerative back condition)
3)She is permanently disabled and is not likely to ever go back to work and will live with her parents until she dies. She is also on Oxygen for about 1/2 part of the day.
4)She lives with her parents in a converted garage with no insulation. (the kids stay with her in that garage when visiting) At Christmas, she was found on the floor by her parents with no pulse and was hopitalized for 45 days and almost died.
5) Brother lives in the house is a self professed gang member and deals drugs.

They are going to mediation in 2 weeks and was wondering if the law still favors Mom's (no matter how screwd up) over the Dads?
