Hello,
My husband has an 18 year old boy. He has always paid his childsupport. They had no paperwork for anything. His son goes to highschool parttime and works 40 or more hours a week. He pays for everything and we found out that he's giving his mother money also. Anyway, after he turned 18 he stopped paying the childsupport. His ex-wife has threatened to take him to court. He told her that unless a judge told him to pay it he wasn't going to pay it. His ex-wife said that he was going to have to pay her lawyer fees and court cost if it goes to court. We haven't heard anything from her lawyer yet. We've been putting the money in the bank in case she does take him to court. My question is will he have to pay her attorney fees?

Correct me if I'm wrong, but I believe Child Support continues until the age of 18 or if the child goes into college, then it's either 21 or when he/she graduates.

Since child support was never court ordered and if she takes you to court, you may have to show proof of your child support payments.

Good Luck!

Go here: http://ocse3.acf.dhhs.gov/ext/irg/sps/report.cfm?State=NC&CFID=354360&CFTOKEN=8806600

Read it all especially the age of majority section. In NC, it appears that if it is not addressed in the court order, CS ends when the child turns 18. It's a little fuzzy though, so you may want to contact an attorney.
