During the summer we rotate weeks with our son. Our son attends daycare after school. when Child Support was issued 3 years ago it daycare was based on what I paid which was $80 a week. This year it went down to $75 a week because he is in school full time. During the summer the cost of child care goes up to $120.00 a week because he is there full time and cost of field trips. I told my ex that I would pay the $75 weekly and that he would have to pay the difference on his weeks because child support does not include this extra cost. I would pay the difference on my weeks. He claims it isn't his responsibility and that I should pay for the additional cost on his weeks also. I feel it is only fair that he pay the additional costs since as he puts it "son" is on my time and my responsibility. any thoughts??

Unless he is ordered to do so, he is under no obligation to pay it. And "field trips" are not a basic need of the child, it would fall under extracurricular activities. If the order doesn't mention these, he doesn't have to pay.

He is obligated to pay the court order; nothing more and nothing less.

Another take...if your court order does not state who is responsible for paying daycare expenses, then you're not technically responsible for providing daycare during his weeks.

I'm having the same problem with this summer. Ex gets 4 straight weeks of visitation during the summer. My daycare bill goes up from $65/week to $125/week (all-inclusive fee which pays for summer activities). My attorney said I didn't have to provide daycare during the ex's visitation, which means that I'll pay a $20 enrollment fee for the first couple weeks of summer, then unenroll him during ex's visitation and re-enroll him when my son comes home.

Ex doesn't live anywhere near my daycare anyway, so it's most unlikely that he'd want to keep him in the local program. He'll find some other program to enroll him in (or a relative to help with child care).
