my fiance adopted his ex-wifes daugther.Her father is in prison and gave up rights.he adopted her when she was two years old.they divorced when she was 8.she is now 14 and he would not know her if he walked up to her today.he tryed to stay in her life and be a dad to her and one day he went to get her and her mother had totally turned her against him.he messed up and committed adultry and she told the child all about it so in her mothers defense she decided she hated him.the mother has taken him to court and he pays 375.00 a month and it is all for revenge the mother chased him down one day and caused him to lose his job and all and ler him know she will get him back.she lives in a 280,000 dollar home with another man and she had taken all rights from neal to be a dad in fact she told him he was not her dad.but he pays a lot of child support.he makes 1100.00 a month after paying her and i need to know if something can be done it is not fair that she can get away with this.can he give up rights after all he does not know this child at all and someone else is supporting her.he did try and be her father now it is to late.please help.

No. He is legally the Father because of the adoption. He is financially responsible for the child. If he wants a relationship with the child he has to fight for one. If he does not, then pay the child support and live happily ever after.

When a couple is divorced, there is usually a visitation agreement in the divorce degree, if there is, then he can take her back to court and show her in contempt of a court order and force her to let him see the child. Check on the laws of your state though, she may be at the age when she, the child, can decide if she wants to visit with the father. If there is no visitation order, he can take her back to court anyway and request visitation. However, with the child support, there is nothing he can do except to go to child support enforcement and attempt to have it lowered. Be careful in doing this, if he has received any raises at his job, it may get raised on him. But, if he has changed jobs and now makes less than he did when the child support was ordered, he may be able to get it lowered.
