Either one of the biological parents- typically the one with whom the child resides...unless, of course, the other parent picks the child up and doesn't return it. Until they file for custody it could be either of them.
It depends entirely upon the state. In some states, joint custody is presumed & in others, custody goes to the mother by default. It's best to check your state statutes.
