The full story is,
We were currently renting but the comany that owned the home (kelly investments) decided to sell all the homes in the area and gave a notice 2 everyone 2 vacate in 1 month which was not enough time for us to look for another place to live. We were both going 2 school & working full time and it was around the time we took our finals (very bad timing).

We decided to get a home, which now I know was a HUGE MISTAKE :mad:, but at the time we had convinced each other that this was the best choice and it was completed quicker that we both expected.
Since my brother didnt have enough income to support the mortgage alone I had to sign the contract as a co-guarantor so we could be approved for the home.

We got approved and 2yrs down the road I decided to get a place on my own. I verbally told him this & he verbally agreed to this not ever telling me that I would still have to pay rent. I continued to pay rent for about 6 months. I then decided that I shouldn't be paying since I wasnt living there. So I stopped for the next 18 months till I moved back. When I moved back in my brother expected me to pay back the 18 months that I didnt give him for rent.

I feel he is unfair especially since he keeps all the tax benefits and makes the decisions on improving the home without confronting me with it (i.e. during the time I was living somewhere else). Several improvements I didn't mind, but a few things I wouldnt have approved of.

Since we got the house 4 years ago I never benefited off of anything that you can when owning a home. He took the credit for everything. I really didnt care about this since he wanted the house & I just needed a place to stay when we got "kicked" out of our old house that we were renting. Now that hes expecting more that what I feel I should give him I see different and want to end this, but the right way without causing anymore problems for me.

So theres the whole story. Not too enlightening and I learned a valuable lesson here. So is there any advise you can give. By the way he is not able to carry the mortgage on his income alone otherwise he could've refinanced & I could be as a tenate paying him rent.

**A: then sue him and force him to sell the property to get you off the mortgage loan..
