Hello!
I'm working with a Debt Counseling Service and they have Power of Attorney, so they have contacted all of my creditors several times but the creditors continue to call me constantly at work and at home. Sometimes even late at night and several times within a two hour period. Is there anything I can do to stop them from harassing me??? It's getting out of control.

The Service I'm working with to handle this for me told me that I'm not obligated to speak with them, or even to answer the phone and that they have contacted them all.....but the calls are constant. Please help!

Cease Letter for Collection Calls

Thanks for the reply. So in other words, I need to contact the Credit Service that I'm using now and they submit this letter to my creditors. Is that correct?
Second question is what is the next step if creditors choose to ignore the letter?
 
No, your credit service has already screwed up by not sending the letter for you. You need to do this yourself.

If they choose to ignore the letter you can sue them under FDCPA
Section 805 (c) for $1000. (That's a last resort of course). It's better to let them stack up violations to use against them as leverage to have items removed from your credit report.

Collection Agency

We're talking about collection agencies. I'm paying a company now to handle my debts.

just a note on some facts. a company doesn't have to accept a proposal from your consumer credit company. ex. your minimum payments are $50.00 and your company sends the creditor a proposal for $25.00. your creditor looks over it and decides it needs $35.00. If a company denies a proposal and you are not aware of it, your account is just going to get that much more behind and delinquent. A ceased and desist sounds good, but is risky when you are with a consumer credit company. I highly suggest you call all of your creditors and ask if they have gotten the proposal and have accepted it. Some of the companies calling you might have denied it or never gotten the proposal. With most, if not all companies, once they have accepted a proposal and they receive the payments each month on time, they will not contact the customer. A consumer credit company will tell the customer not to worry about the accounts. However, they are still your accounts and not to be negative, but a lot of consumers who go with consumer credit companies are not successful. The best chance to be successful is to know what is happening. Also tell the creditors to not call you at work, they have to abide by that. best of luck.
