What is the name of your state? NJ

at what age does child support end in nj> my husband has a child from a previous relationship (never married) the boy will be 20 in april and he is attending college (a freshman). the mother wants the dad to pay 1/2 the college expenses and wants to take him for more child support. we have 4 small children from our marriage. We both do well financially.

does he still have to pay child support and college expenses. and if so, would my income be included (he is not my child)

CS in NJ is generally until 18 or graduating from HS. What does Dad's support order actually say? Does it provide for post-majority support?

I'm not sure exactly (i can try to find out) but he is under the impression that he is to pay child support while she is a full time student - until she is 23. I do not believe he went to court, rather she petitioned the court for child support and he has been paying it since. She now has a lawyer that is stating that he is to pay the 1/2 of the 1st sem. and 1/2 thereof, and that she is going to petition the court for more child support.

In my opinion, NJ is one of the worst states to be paying support. Go here:

Read it all, especially the section on age of majority. Support could continue on for a very long time, and he could easily be ordered to pay for college. Support does not automatically stop.

I am not sure what age the cut off is in your state but normally ordered support ends when a child turns 18 or is out of High School. Unless you have placed into an agreement that you wish to continue to support the kids into college, at least here in Florida, You are not responsible to pay support for them to the parent after they have turned 18 and or graduated from High School. You may want to send money directly to your child at this point in time. Mom just no longer can demand or hold the purse strings any longer.

You may just want to click on the link that VG posted as it will tell you exactly how it works in NJ. In our fine state, CS may carry on past 18 - the court decides on a case-by-case basis.

Well Glad that it isn't my state that makes a parent responsible for Adult Children. I have 2 already through school and luckily they had grants and scholarships or else their father and I would both be broke, however here the law states Court ordered support is only until the child is 18 years of age and or out of school and 18. If the child is 19 before he graduates HS... you must pay until he graduates HS but unless arrangements are made between the parties or before the courts for additional support agreed to by both parties, CS ceases at when an 18 year old is out of school. ;)

I have been going through the same thing. I live in Mo

Mo. states you pay child support until 22 if the child is a full-time
(12 credit hours) student and "completes" 12 credit hours per semester.
The college issue was in our divorce decree.

Here is the tricky part. If child is taking say 14 credit hours and flunks or
withdraws from a 3 credit hour class this will drop the child from "completing the 12 credit hours" and the child can therefore be emacipated.

One of my twins withdrew from a class he was failing and only had 11 credit hours and even thought he re-enrolled in the same school, Dad jumped on this and was able to emacipate the child.

The other twin barely made his 12 credit hours and Dad still has to pay.

Doesn't seem too fair for the twins does it?

Please start your own thread and don't hijack a thread. But to answer your question, it sounds like your twins are not serious about school and don't qualify for post secondary support. It's not fair for your children to expect their college to be paid for and not pass 12 credit hours.

met4nzkx, I wasn't hijacking Lavida thread, nor was I asking for an opinion. I was trying to inform Lavida of the 12 credit hour rule. Lavida was asking about child support and college expenses. They wanted to know how long they had to pay.

But you are right met4nzkx. I don't think they are serious about college and my ex or myself shouldn't have to pay for college. But that's the law in my state.

So......Lavida, check your state law as to what the child has to maintain in grades for you to have to continue paying for college expense. Child support enforcement can give you the statue for emacipation but if your decree states you have to pay for college then you have to pay. The child also has to send you copies of his/her grades, tuition and so on in order for you to continue paying expenses.

It would have to be taken to court as NJ handles these types of issues on a case-by-case basis.
