College Student & Lump sum Child Support?

Hi,

I know I have read on here that you cannot pay lump sum child support because it could be taken in every 3 years or so to be increased.

DH has a 21 yr old daughter in college. Due to graduate in May 2007. He pays directly to the ex. Reduced CS when daughter away at school.

He wants to offer ex full child support for 1 year. Still pay his portion of college for the next 2 semesters. If by some chance she does not graduate in May 2007 but the next semester, also pay his portion of that semester. Offer to pay his portion of daughters car insurance for 2 years. And not claim daughter on taxes for 2007. (they take turns claiming her)

Could something like that be done? It would definetly benefit the ex as she comes out ahead of the game by several thousand dollars.

Child support can be taken in at any time to be changed. mom could agree to this on paper and everything and then go back the next day to court and file a change of child support. I know some states (if you pay through the state and if you don't then you can request to) will take overpayments and credit them to your account for future payments but you would have to check with your local office. I am not trying to be sceptical but if I was mom it would sound a little fishy to me. i would wonder if dad was coming into a large sum of money and didn't want to give me any of it for support. It is the only reason why I would think that you would want to pay in advance.

also mom can argue since you can afford to pay the lump payment all at once perhaps you can afford more child support and she could request an increase!

why would your husband WANT to do this?

Jorgabell has posted on this topic (stepdaughter) before.. and the REASON her husband wants to do this is NOT to cheat the ex or daughter, but because the ex and daughter use husband as an ATM machine!!

I cant give you legal advice as to whether its possible as Im not in NJ (there are posters on here who would know and can advise you) HOWEVER, I hope it works out for you... as it sounds MORE than generous on your husbands (and your) part. (especially after reading the prior posts).

He is not coming into a large sum of money, but tax return added to some savings that we have.

He said he just wants to be done with child support. He and his daughter don't have a very good relationship at all. He pays CS right to ex. And contributes to college. Pays 1/3 of car insurance. When something else is needed he contributes to it.

Ex makes more than DH.

He figures it's only another year or so, this way he can be done with it and not deal with the ex any more.

Of course if it was legal to do, he would want it filed with the court.

It was just something he was considering. He would be better off not doing it, as it would save him money. He says it is just not worth the aggrevation from the ex.

It is not paid thru child support office. If it is a legal thing to do then after all the paperwork was done and filed with the court he would give ex a check.

Thanks CarrieT, I also think it's more than generous for him to do this. He is tired of being stepped on by these 2 and says it would be worth it to get it over with. He does not want to cheat them, he doesn't mind paying the support but is tired of all the crap.

He just wants to see what other options he has and was curious if this was legal.
